Terms of Service

These Terms of Service ("Terms") govern your use of the DropDex TCG mobile application and website at dropdex.app (collectively, the "Service"), operated by DropDex TCG ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old to use DropDex. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Account

You sign in using Apple Sign In. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account. Notify us immediately at support@dropdex.app if you believe your account has been compromised.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.

3. Subscriptions and Billing

DropDex offers a free tier and a paid Pro subscription. Subscriptions are billed through Apple's in-app purchase system.

• Free trial: New users receive a 7-day free trial of the Pro tier. The trial automatically converts to a paid subscription unless cancelled before the trial period ends.
• Billing: Subscription fees are charged to your Apple ID at confirmation of purchase and at the start of each renewal period.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
• Refunds: All refund requests are handled by Apple in accordance with their purchase terms. We do not process refunds directly.
• Price changes: We reserve the right to change subscription pricing. We will provide advance notice of any price changes, and continued use after the change takes effect constitutes acceptance.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Scrape, crawl, or systematically download data from the Service
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to resell or commercially exploit stock alert data without our written permission
• Create multiple accounts to circumvent subscription requirements
• Use automated means to interact with the Service beyond normal app usage

5. Stock Data and Accuracy

DropDex monitors retailer websites and APIs to provide stock availability information. We do not guarantee the accuracy, completeness, or timeliness of stock data. Retailer inventory changes rapidly and information displayed in the app may be delayed or outdated by the time you act on it.

DropDex is not responsible for failed purchases, out-of-stock situations encountered after following an alert, price discrepancies, or any losses resulting from reliance on stock information provided by the Service.

6. Affiliate Relationships

DropDex participates in affiliate marketing programs, including but not limited to the Walmart Affiliate Program, Target Affiliate Program, and Amazon Associates. When you purchase through a link in the app, we may earn a commission at no additional cost to you. Affiliate relationships do not affect which products are shown or the objectivity of stock alerts.

7. Intellectual Property

The DropDex name, logo, app design, and original content are owned by us and protected by copyright and trademark law. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

All Pokémon names, characters, and related marks are trademarks and copyright of The Pokémon Company International, Nintendo, Game Freak, or Creatures Inc. DropDex TCG is an independent application and is not affiliated with, endorsed by, or sponsored by any of the Pokémon Rights Holders.

8. Third-Party Services

The Service integrates with third-party platforms including Apple (Sign In, Push Notifications, In-App Purchase) and RevenueCat (subscription management). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DROPDEX TCG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless DropDex TCG and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 10, and 11 survive termination.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page when we do. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
